On January 29, 2025, the U.S. Department of Commerce announced a preliminary affirmative determination in its ongoing antidumping duty (AD) investigation into brake drums imported from China. This means that, according to Commerce’s findings, Chinese manufacturers have been selling certain brake drums in the U.S. at prices below fair market value, which could harm domestic producers. According to the preliminary findings, the estimated dumping margin is 109.64% to 160.79% ad valorem. This means that Chinese brake drums are being sold at roughly 160% below fair value, based on U.S. trade laws. If this margin is confirmed in the final determination, the U.S. will impose significant antidumping duties on these imports, making them much more expensive and potentially reducing their market share in the U.S.

What Happens Next?

This is a preliminary determination. Commerce will now continue its investigation, reviewing additional data, verifying company records, and allowing stakeholders to submit comments. Companies and other interested parties have until February 24, 2025, to submit case briefs, with rebuttal briefs due by March 3, 2025. The final determination is expected later in 2025. If Commerce upholds its preliminary findings, the U.S. International Trade Commission (ITC) will then decide whether these unfair trade practices have caused or threaten to cause material harm to U.S. manufacturers. If both agencies confirm injury, the duties will become permanent.
